IMPORTANT. Please read the following Terms and Conditions carefully. They govern the use of this website, the relationship between You (or "Your") and Parker Travel Associates, Inc. ("We," "Our," 'Us," "Parker Travel" or "Parker"). Your use of this website shall acknowledge your having read and understood these Terms and Conditions, and shall constitute your acceptance of these Terms and Conditions, without change. If you do not agree with any of these Terms and Conditions, you must not use this website (or “Site”), and must immediately exit the website.

Use of this Website

The content and information displayed on this Website (“Materials”) is the property of Parker Travel and / or other parties. The downloading, reproduction, or retransmission of Materials, other than for non-commercial individual use, is strictly prohibited. This Website is for personal use only. Commercial uses of this Site are strictly prohibited. If you are a user for personal, non-commercial purposes, you are granted a limited, non-transferable, revocable license to view and copy the Materials solely for your personal use, subject to the restrictions below.

The contents of this Website include information, graphics, images, and other data which have been obtained from tour suppliers and other third parties. The accuracy of the information on this Website is not guaranteed. You must verify the information with the tour operator or Parker’s agent at the time of booking.

You agree not to:

(a) copy, display, modify, reproduce, or otherwise transfer any of the Materials to any third party without the prior written permission of Parker Travel;
(b) interfere with or disrupt networks connected to the Site;
(c) use or attempt to use any device, software or routine which can interfere with the proper functioning of the Site or any transactions being offered through the Site;
(d) transmit files, data or other materials containing a computer virus, corrupted data, worms, “Trojan horses” or other instructions or design that would erase data or programming or cause the Site or any equipment or system to become inoperable or incapable of being used in the full manner for which it was designed;
(e) deliver any communication to or through the Site which violates any local, state, federal or international law;
(f) deliver any communication to or through the Site that contains defamatory, libelous, abusive or obscene material; or
(g) deliver any communication to or through the Site that will infringe upon the rights of any third party.

Travel Services Provided

The travel services offered on this site, including tour packages and related transportation, whether by air, land and / or sea, are provided by third party service providers. None of the transportation or tour services are operated by Parker Travel. Parker Travel will work with you, to assist you in selecting an appropriate tour or other travel services.

Our Tour Discounts

In some cases, the discount is deducted directly from the payments made to the participating Tour Operator. In other cases, the discount will be provided to you in the form of a Rebate which will mailed to you upon completion of your tour.

Deposits and Payments

Each tour operator and other service provider sets their own terms and conditions relating to deposits and payments. In most cases an initial deposit is required at the time of booking. Information on this Website provides general payment information for each major tour operator featured, but is not guaranteed to be accurate. Furthermore, the payment requirements are subject to change from time-to-time. We will advise you of the payment requirements at the time of booking.

Changes and Cancellation Chargers

As with payments, cancellation penalties and fees will vary by the services providers. Prior to confirming your tour services, Parker will advise you of the cancellation fees which might apply. Once services have been confirmed, any change may be subject to a change fee. Changes to the names of tour participants or the dates of travel will be considered a cancellation and rebooking, and may be subject to substantial penalties.

Air Transportation

Parker Travel may use air travel arrangements provided by the tour operator, or may use special, negotiated, private, or published airfares for its clients in conjunction with tour services. Some airfares may be subject to a service fee. All fares quoted are subject to change until ticketed. The air carriers involved set the penalties and restrictions as to cancellation and / or changes.

Travel Insurance

Parker Travel stongly recommends that the client purchase a travel insurance program which covers baggage, trip interruption and cancellation. Parker Travel is not liable for any accident, injury, or illness, and is not liable for theft, damage, or loss of personal effects or baggage. We will provide you with information on available travel insurance or other travel protection plans at the time of booking.

Limits on Parker Travel's Responsibility

Parker Travel Associates, Inc., its officers, directors, employees, successors, assigns, agents and / or affiliates (collectively, "Parker") does not own or operate any entity which is to or does provide tour services or transportation to Parker's clients. All such services, including hotels and other lodging, restaurants, transportation (whether by air, land, sea, or combination), sightseeing, ground handling and other services, are provided by third parties ("suppliers") that are not subject to the control of Parker. Parker cannot be held liable for any personal injury, property damage, or any other consequential loss or damage, which occurs as a result of actions by its suppliers or by any third party. Additionally, and without limitation, Parker cannot be held liable for any injury, death, illness, inconvenience, or delay or damage to any personal property which may be result from acts of God, force majeure, war, civil unrest, criminal or terrorist activity, disease, animals, strikes or other labor activities, or food poisoning. Furthermore, Parker is not responsible for any delay or interruption of services as a result of any weather conditions, mechanical or other technical problems with aircraft, passenger vehicles, vessels, or other conveyance. In no event will Parker be liable for any consequential, incidental or special damages for loss suffered by any person. Parker's maximum liability, for whatever cause, shall be limited to the amount paid to Parker for its services. As certain activities involved in tour features may be inherently dangerous, including, but not limited to, rafting, hiking, horseback riding, scuba diving, or skiing, by participating in any such dangerous activity, the Participant assumes all such risks with regard to these activities.

Airline Responsibility Clause:

The airlines involved are not to be held responsible for any act or occurrence which might occur during which time the Participant is not on board their aircraft. The passenger travel documents, when issued, whether ticketless, electronic tickets or paper tickets, shall constitute acceptance by the Participant of the Contract of Carriage as the sole contract between the airline involved and the Participant.

Passports, Visas and / or Other Travel Documents

Parker Travel will provide you with information as to required passports, visas and / or other travel documents required for your international travel. We will provide information which we believe to be accurate; however, it is the sole responsibility of each traveler to obtain the necessary travel documents, and ensure that all documents are in order. It is recommended that you contact the various Consulates or Embassies to verify current requirements and procedures.

Copyright and Trademarks

All material on this website should be assumed to be copyrighted, either by Parker Travel or other parties, and may not be downloaded or used without the prior written consent of Parker Travel, except when the information is to be used in the promotion of Parker Travel's services. All trademarks, service marks, logos, and designs are trademarks of Parker Travel and others. Discount-Tours-Plus.com is an internet address of Parker Travel Associates, Inc.

Modification of These Terms and Conditions

Parker Travel may modify these Terms and Conditions at any time. Please check back to view the current Terms and Conditions prior to booking travel arrangements.

Severability

These Terms and Conditions are to be deemed severable. Should any provision be determined to be invalid or unenforceable, said provision shall be enforced to the extent permitted by applicable law, and any such determination shall not affect the validity and enforceability of the remaining provisions.

Dispute Resolutions Agreement

Any controversy or claim arising out of or related to these Terms and Conditions, the Limits on Parker Travel's Responsibility clause, any other information relating to the tour program in any way, to the trip itself, or to any services related to the trip, shall be settled solely and exclusively by binding arbitration to be held in Orlando, Florida, in accordance with the Expedited Procedures provisions of the Commercial Arbitration Rules of the American Arbitration Association ("AAA"), except that: (a) there shall be a single arbitrator, appointed by AAA; (b) the use of discovery shall not be permitted; (c) the arbitrator shall solely determine questions of law and admissibility of evidence; and (d) each party shall bear its own costs and expenses, including travel, counsel, and witnesses, and an equal share of the administrative, arbitrator and venue-rental fees
